1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of naconix.com (the "Site") operated by Naconix ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. About Our Services

Naconix provides software engineering, cloud infrastructure, and related consulting services to business clients. The Site is an informational and marketing resource. Descriptions of services on the Site are for general information only and do not constitute a binding offer.

Any paid engagement with Naconix is governed by a separate written agreement (such as a statement of work, master services agreement, or similar contract) that will supersede these Terms with respect to that engagement.

• Scrape, crawl, or harvest data from the Site without our prior written consent, except as allowed by standard search engine indexing
• Misrepresent your identity or affiliation when contacting us

4. Intellectual Property

The Site and its content — including text, graphics, logos, icons, design, and software — are owned by Naconix or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from Site content without our prior written permission, except for temporary copying necessary to view the Site in a browser.

Client names, logos, and trademarks displayed on the Site belong to their respective owners and are used with permission or for identification purposes.

When you submit information through our contact form or email, you represent that the information is accurate and that you have the right to provide it. You grant us permission to use that information to respond to your inquiry and for related business purposes as described in our Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NACONIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.

You agree to indemnify and hold harmless Naconix and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.

We may revise these Terms at any time by posting an updated version on this page. The "Last updated" date indicates when the Terms were last changed. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
